This is an application for Anticipatory Bail. 3.

The applicants are apprehending their arrest in Crime No. 346 of 2025 registered at Sion Police Station, for the offences punishable under Sections 420, 504 & 506 read with 34 of the Indian Penal Code, 1860.

The allegations against the present applicants are of defrauding the first informant to the tune of Rs.48,50,000/-. 1/6

The learned counsel for the applicants and learned counsel for the first informant jointly submit that the parties have amicably settled their dispute and tendered the consent terms to that effect, which are taken on record and marked as "X" for the purpose of identification. The learned counsel for the applicants has also tendered the affidavit of the applicants, the same is taken on record. For ease of reference, the consent terms are scanned and reproduced herein below :

I have perused the FIR. The dispute between the parties appears to be about non-return of money. Considering the fact that the parties have amicably settled their dispute, I am inclined to release the applicants on anticipatory bail. In the result, the following order is passed :

O R D E R

a) The Application is allowed.

b) In the event of arrest of the applicants in connection with Crime No. 346 of 2025 registered at Sion Police Station, for the offences punishable under Sections 420, 504 & 506 read with 34 of the Indian Penal Code, 1860, the applicants be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- each with one or two sureties in the like amount.

c) The statements made in the consent terms are accepted as undertaking to this Court.

d) In case of breach of consent terms, liberty is granted to the first informant to file an application for cancellation of present anticipatory bail. [N.R.BORKAR, J.] 6/6
