This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail in connection with C.R. No.213 of 2024 registered with Malegaon Police Station, Pune, for the offences punishable under Sections 109, 140(1), 118(2), 189(2), 189(4), 190, 191(2) and 191(3) of the Bharatiya Nyaya Sanhita, 2023 and Sections 37(1)(3) and 135 of the Maharashtra Police Act, 1951.

The prosecution case is set out in paragraph Nos. 2 to 5 of the order dated 28th May 2025 passed by the learned Additional Sessions Judge, Baramati, Dist. Pune in Criminal Bail Application No.1451 of 2024, which reads as under:

"2] Brief facts of the prosecution case are :- It is case of the informant Balasaheb Laxman Jadhav that his son Akshay is serving as Home guard. On 08/09/2024 Akshay returned to home at about 6.30 p.m. When he reached near home, two unknown persons came there and they have some talk with Akshay. After talk, both of them have taken Akshay with them on the motorcycle of Akshay bearing No. MH-42-AC-6257 and left that place.

3] Thereafter, at about 7.00 p.m. the informant received phone call of Akshay's friend Vishal Nalwade. Vishal Nalavade told the informant that he and his brother saw five to six persons while beating Akshay with wooden sticks near Tukai Hill. They saw those assailants while leaving the place of incident after beating. They reached near Akshay and saw that he has sustained head injury and lying in a pool of blood. They have taken Akshay to Devkate Hospital Baramati.

4] On receiving the said information, the informant immediately rushed to Devkate Hospital, Baramati. Doctor gave first aid to Akshay and asked to take him to another hospital for further treatment. Therefore, the informant has admitted Akshay in Wable Hospital, Baramati. During treatment the informant inquired with Akshay as to what

happened with him. At that time Akshay told him that cousin sister of Amit Avinash Kamble i.e., Diksha Rajendra Kambale is his friend. The family members of Diksha came to know about their friendship. Therefore, her brother Yash Kambale and his friend Utkarsh Bhosale came near their house, asked Akshay to sit on motorcycle, took him to behind Malegaon Engineering College, near Neera Left Canal, in isolated place. There, Amit Kamble and three other unknown persons were present with sticks. All of them started beating him saying that, why he is influencing Diksha Kambale and they will kill him. Then, the informant went to police station and lodged report of incident with Malegaon Police Station.

5] On the basis of his report, crime vide Crime No.213/2024 for the offence punishable u/Secs.109, 140(1), 118(2), 189(2), 189(4), 190, 191(2) 191(3) of B.N.S.2023 and under Sec.135 of Maharashtra Police Act came to be registered at Malegaon Police Station, Taluka Baramati, District Pune against the accused. Accused/applicant is having apprehension of his arrest, so he has moved this application for grant of anticipatory bail. 4.

It is the submission of Mr. Pawar, learned Counsel appearing for the Applicant that the role assigned to the present Applicant is that he has assaulted the injured with a wooden stick. He submits that the Applicant is ready to co-operate with the investigation and the chargesheet is already filed. He submits that there are 7 accused, 3 accused have been released on anticipatory bail and 1 accused has been released on regular bail. He submits that

although there are 2 antecedents against the Applicant, the Applicant has been released on bail in those cases. He submits that the Applicant will completely co-operate with the investigation and he will comply with all the terms and conditions of bail, therefore, the Applicant be granted pre-arrest bail.

On the other hand, Ms. Newton, learned APP appearing for the Respondent-State strongly opposes the Anticipatory Bail Application. She submits that the Applicant is involved in very serious crime. She submits that there are two antecedents under Sections 307 and 302 of the Indian Penal Code, 1860 against the Applicant and therefore, the Anticipatory Bail Application be rejected.

Perusal of the record shows that the injured was having friendly relationship with the sister of the accused No.1 and therefore, all accused questioned the injured about the same and assaulted injured with wooden sticks. The chargesheet is already filed. Although the Applicant has antecedents, he has been released on bail in those cases.

Accordingly, the case is made out for grant of Anticipatory Bail by imposing certain conditions. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant-Tejas Santosh Londhe in connection with C.R. No.213 of 2024 registered with the Malegaon Police Station, Pune, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.50,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the Malegaon Police Station, Pune on every Sunday between 11:00 a.m. to 01:00 p.m. till conclusion of the trial.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade

such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.
