This application is filed by the Applicant under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS") seeking pre-arrest bail in connection with C.R. No. 511 of 2025 registered on 14th October 2025 with Vimantal Police Station, Pune City for the offence punishable under Section 75(1)(i) of the Bharatiya Nyaya Sanhita, 2023 ("BNS") and for the offences punishable

under Sections 8 and 12 of the Protection of Children from Sexual Offences Act, 2012 ("POCSO").

Mr. Gaikwad, learned Counsel for the Applicant states that the Applicant is senior citizen of 72 years. He is retired Army Officer and has served the Nation. He possesses distinguished service record and has participated in Major Defense Missions. The Applicant is the recipient of numerous military awards for his service. He further states that the Applicant will stay outside the Pune City and he will stay at District-Satara. 4.

As the offence is under the POCSO, notices is required to be issued to the First Informant i.e. Respondent No.2. 5.

Although, the offence is very serious, considering that the Applicant is senior citizen of 72 years, interim protection can be granted.

Accordingly, following order is passed :

O R D E R

(a) Issue notice to the Respondent No.2, returnable on

08th December 2025. To be shown fairly "high on board". In addition to the Court notice the Investigating Officer to inform the Respondent No.2 about the next date of this Anticipatory Bail Application.

(b) In the event of arrest of the Applicant- Sahebrao Chandu Chavan in connection with C.R. No.511 of 2025 registered with the Vimantal Police Station, Pune City- the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount. (c) The Applicant shall attend the Vimantal Police Station on 27th November 2025 and 28th November 2025 between 11:00 a.m. to 02:00 p.m. and thereafter as and when called by the Investigating Officer, till filing of the chargesheet and shall cooperate with the investigation.

(d) The Applicant shall not enter Pune City except for attending the Police Station and Trial.

(e) The Applicant shall attend Satara City Police Station

once a week i.e. on every Sunday between 11:00 a.m. to 02:00 p.m. till the conclusion of the trial. (f) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(g) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(h) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(i) The Applicant shall not leave India without prior permission of the Court.
