Heard Mr. Pawar, learned Counsel appearing for the Applicant and Mr. Karmakar, learned APP for the RespondentState. 2.

By this application filed under Section 438 of the Criminal Procedure Code, 1973 ("CrPC"), the Applicant is seeking pre-arrest bail in connection with C.R. No.1491 of 2022 registered with Chakan Police Station, District - Pimpari Chinchwad, for the offences punishable under Sections 420, 409, 406 and 34 of the Indian Penal Code, 1860 ("IPC") and under Section 3 and 4 of the

Maharashtra Protection of Interest of Depositors Act, 1999 ("MPID Act").

As per the prosecution case, the Accused by inducing the investors has accepted the total amount of Rs.1,22,19,063/-. 4.

It is the submission of Mr. Pawar, learned Counsel appearing for the Applicant that the Applicant is neither the Director not the Agent of M/s Prozone Securities and Brokers Pvt. Ltd. ("said Company") He submits that therefore the Anticipatory Application be granted. There are no other antecedents.

On the other hand, Mr. Karmakar, learned APP, strongly opposes the Anticipatory Bail Application. He submits that the Applicant is involved in a serious crime where the investors have been cheated for an amount of Rs.1,22,19,063/-. 6.

Perusal of the record shows that the Applicant is an employee of the said Company. The main allegations are against Accused No.1 -Indradip Singh and Accused No.2 -Darshan Solanki who are the Directors of the said Company as also are against Accused No.3 -Sunil Jumade and Accused No. 4-Amol Lonkar.

Accordingly, by imposing conditions the Anticipatory Bail Application can be granted.

In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant -Gajanan Rangrao Lohar in connection with C.R. No.1491 of 2022 registered with the Chakan Police Station, District - Pimpari Chinchwad the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

(b) The Applicant shall attend the concerned Police Station on 29th December 2025 and 30th December 2025 between 11:00 a.m. to 02:00 p.m. till filing of the chargesheet and shall cooperate with the investigation.

(c) The Applicant shall furnish his cell phone number and residential address to the

Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel. (e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.
