This is an Application for anticipatory bail. 2.

The Applicant is apprehending his arrest in Crime No.390 of 2024 registered with Meghwadi Police Station for the offences punishable under Sections 419 and 420 of the Indian Penal Code, 1860 and Sections 66(C) and 66(D) of the Information Technology Act, 2000. 3.

The allegations against the present Applicant are of defrauding to the first informant to the tune of Rs. 9,50,000/- . 4.

I have heard Learned Counsel for the Applicant and Learned APP for the Respondent-State.

Learned Counsel for the Applicant submits that the due to certain unavoidable circumstances, the amount was not returned. It is submitted that pursuant to amicable settlement of dispute between the parties, the Mugdha

2 902-ABA 3213-25.doc Applicant has now returned the amount and only Rs.3,00,000/- remained to be returned, which will be returned to the first informant within a period of two months from today.

The first informant is present in the Court. She is identified by the investigating officer, who is also present in the Court. The first informant has tendered the Affidavit wherein she has admitted about amicable settlement of dispute.

In view of amicable settlement of dispute between the parties, I am inclined to release the Applicant on anticipatory bail. Hence, the following order:-

ORDER

i.

The Anticipatory Bail Application is allowed. ii.

In the event of the arrest of the Applicant in Crime No.390 of 2024 registered with Meghwadi Police Station for the offences punishable under Sections 419 and 420 of the Indian Penal Code, 1860 and Sections 66(C) and 66(D) of the Information Technology Act, 2000, he shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or two sureties in the like amount.

iii. The Applicant shall pay the amount of Rs.3,00,000/- to the first informant within a period of two months. 8.

The Anticipatory Bail Application is disposed of in the aforesaid terms.
