This is an Application for transit anticipatory bail. MUGDHA MANOJ PARANJAPE 2.

The Applicant is apprehending her arrest in Crime No.39 of 2025 registered with Cyber Crime Police Station, Thiruvananthapuram City in the State of Kerala for the offences punishable under Sections 318(4), 319(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 66D of the Information Technology (Amendment) Act, 2008. 3.

The allegations against the present Applicant and other co-accused are of defrauding the first informant to the tune of Rs.1,36,50,000/-. 4.

Learned Counsel for the Applicant submits that the Applicant has nothing to do with the alleged crime. It is submitted that the Applicant is a cancer patient. The Learned Counsel submits that the Applicant is willing Mugdha

2 901-ABA 3226-25.doc to appear before the investigating officer for the purpose of investigation pursuant to notice issued to the Applicant under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. It is submitted that to enable the Applicant to approach the jurisdictional court, the Applicant be protected from arrest for a period of four weeks. 5.

Considering the overall facts and circumstances and as the Applicant is willing to appear before the investigating officer pursuant to the notice issued to her under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, I am inclined to protect the Applicant from arrest for a period of four weeks. Hence, the following order is passed :-

ORDER

i.

The Application is allowed.

ii.

In the event of the arrest of the Applicant in Crime No.39 of 2025 registered with Cyber Crime Police Station, Thiruvananthapuram City in the State of Kerala for the offences punishable under Sections 318(4), 319(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 66D of the Information Technology (Amendment) Act, 2008, she shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or two sureties in the like amount for a period of four weeks. 6.
