This is an application for Anticipatory Bail. 2.

The applicant is apprehending his arrest in Crime No. 437 of 2025 registered at R. C. F. Police Station, for the offences punishable under Sections 308(4), 311 & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that on the date of incident, which took place on 03.08.2025, the present applicant and other co-accused assaulted the first informant by a broken 1/4

beer bottle as he refused to pay them extortion money. It is alleged that due to said assault the first informant sustained grievous injury.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

The learned counsel for the applicant submits that the applicant has nothing to do with the alleged crime. It is submitted that alleged assault is attributed to the co-accused Sunny Bhosale. It is submitted that nothing is to be recovered at the instance of the present applicant and therefore there is no need of custodial interrogation. It is further submitted that there are no other criminal antecedents against the applicant. 6.

On the other hand, the learned APP for the respondentState submits that the applicant is involved in serious crime of extortion. It is submitted that considering the nature of crime, the applicant may not be released on anticipatory bail. 7.

I have perused the first information report. The 2/4

allegations of extortion and the assault by broken beer bottle are attributed to the co-accused Sunny Bhosale. There are no other criminal antecedents against the applicant. Considering the overall facts and circumstances, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :

O R D E R

a) The Application is allowed.

b) In the event of arrest of the applicant in connection with Crime No. 437 of 2025 registered at R. C. F. Police Station, for the offences punishable under Sections 308(4), 311 & 3(5) of the Bharatiya Nyaya Sanhita, 2023, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

c) The applicant shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the 3/4

investigation.

d) In case charge-sheet is filed against the applicant, then during the pendency of trial, the applicant shall attend the concerned police station once in a month, i.e., on first Saturday between 11:00 am to 2:00 pm.

e) The applicant shall not commit any other crime.
