This is an Application for anticipatory bail. 2.

The Applicant is apprehending his arrest in Crime No.1204 of 2025 registered with Shantinagar Police Station for the offences punishable under Sections 74, 115(2), 352, 351(2) and 64(2) of the Bharatiya Nyaya Sanhita, 2023.

According to the prosecution, the Applicant and the first informant became acquainted with each other while they were working for the same political party. Thereafter, they started residing together. It is alleged that subsequently some differences arose between them and they began residing separately. It is alleged that on the date of incident, which took place on 01st November 2025, the present Applicant came to the house of the first informant and tried to touch her in an inappropriate manner.

2 909-ABA 3241-25.doc Thus, on 02nd November 2025, report was lodged with the police station and on the basis of said report crime for the offences punishable under Sections 74, 115(2), 352, 351(2) of the Bharatiya Nyaya Sanhita, 2023 was registered. Subsequently, on 03rd November 2025 in the supplementary statement the first informant has alleged that on 01st November 2025 the present Applicant forcibly committed sexual intercourse with her.

I have heard Learned Counsel for the Applicant and Learned APP for the Respondent-State.

Learned Counsel for the Applicant submits that the Applicant and the first informant were in a live-in relationship for about four years. It is submitted that the false allegations are made with an ulterior motive. 6.

On the other hand, Learned APP for the Respondent-State submits that the Applicant is involved in serious crime of rape. It is submitted that considering the nature of crime, the Applicant may not be released on anticipatory bail.

I have perused the FIR. The FIR shows that the Applicant and the first informant were in a live-in relationship. Prima facie, the allegations in respect of forcible sexual intercourse appears to be an attempt to involve the present Applicant in a serious crime. Considering the facts and circumstances of the case, I am inclined to release the Applicant on anticipatory bail. Hence, the following order:-

ORDER

i.

The Anticipatory Bail Application is allowed. ii.

In the event of the arrest of the Applicant in Crime No.1204 of 2025 registered with Shantinagar Police Station for the offences punishable under Sections 74, 115(2), 352, 351(2) and 64(2) of the Bharatiya Nyaya Sanhita, 2023, he shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or two sureties in the like amount.

iii. The Applicant shall not enter into the limits of Bhiwandi Municipal Corporation till conclusion of trial except when he is called by the Investigating Officer for the purpose of investigation.

The Anticipatory Bail Application is disposed of in the aforesaid terms.
