This is an application for Anticipatory Bail. 2.

The applicant is apprehending his arrest in Crime No. 1766 of 2025 registered at Mumbra Police Station, for the offences punishable under Sections 3(5), 351(2), 352, 115(2), 85 & 108 of the Bharatiya Nyaya Sanhita, 2023.

The present applicant is the father-in-law of the deceased. It is alleged that the present applicant and the husband of the deceased were mentally and physically ill-treating her, due 1/4

to which, on the date of incident, which took place on 03.11.2025, the deceased committed suicide by hanging herself at her residence. It is alleged that on the date of incident, the deceased had called the first informant and told her that the co-accused husband was threatening to divorce the deceased as well as forcing her to leave the matrimonial residence. 4.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

The learned counsel for the applicant submits that the applicant was not residing with the deceased and her husband. It is submitted that afterthought false allegations are made against the present applicant. It is further submitted that there is no need of custodial interrogation and the applicant is ready and willing to co-operate in the investigation.

On the other hand, the learned APP for the respondentState submits that applicant is involved in a serious crime of abetment to suicide. It is submitted that the deceased died within seven years of marriage. It is submitted that there are specific 2/4

allegations against the present applicant in the FIR. It is thus submitted that, considering the nature of crime, the applicant may not be released on anticipatory bail.

I have perused the First Information Report. The main allegations are against the husband of the deceased. On the date of the alleged incident, which took place on 03.11.2025, the husband of the deceased allegedly threatened to give her a divorce and told her to go to her maternal house. Prima-facie, the said threat appears to be the cause for the deceased to commit suicide. In that view of the matter, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :

O R D E R

a) The Application is allowed.

b) In the event of arrest of the applicant in connection with Crime No. 1766 of 2025 registered at Mumbra Police Station, for the offences punishable under Sections 3(5), 351(2), 352, 3/4

115(2), 85 & 108 of the Bharatiya Nyaya Sanhita, 2023, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

c) The applicant shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation.
