This is an Application for anticipatory bail. 2.

The Applicant is apprehending his arrest in Crime No.437 of 2025 registered with R. C. F. Police Station for the offences punishable under Sections 308(4), 311 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.

It is the case of the prosecution that on the date of incident, which took place on 03rd August 2025, the present Applicant and other coaccused assaulted the first informant by a broken beer bottle as he refused to pay them extortion money. It is alleged that due to said assault, the first informant sustained grievous injury.

I have heard Learned Counsel for the Applicant and Learned APP for the Respondent-State.

Learned Counsel for the Applicant submits that the alleged assault is attributed to the co-accused Sunny Bhosale. It is submitted that nothing is to be recovered from the present Applicant and therefore there is no need of custodial interrogation.

On the other hand, Learned APP for the Respondent-State submits that the Applicant is involved in serious crime of extortion. It is submitted that the Applicant is also involved in one more crime for the offence punishable under Section 324 of the Indian Penal Code. It is submitted that considering the nature of crime, the Applicant may not be released on anticipatory bail.

I have perused the First Information Report. The allegations of extortion and the assault by broken beer bottle are attributed to the coaccused Sunny Bhosale. Considering the overall facts and circumstances, I am inclined to release the Applicant on anticipatory bail, subject to certain conditions. Hence, the following order:-

ORDER

i.

The Anticipatory Bail Application is allowed. ii.

In the event of the arrest of the Applicant in Crime No.437 of 2025 registered with R. C. F. Police Station for the offences punishable under Sections 308(4), 311 and 3(5) of the Bharatiya Nyaya Sanhita, 2023, he shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees

3 6-ABA 3314-25.doc Twenty Five Thousand Only) with one or two sureties in the like amount.

iii. The Applicant shall not enter into the jurisdiction of R. C. F. Police Station for a period of one year except for the purpose of investigation, if called by the investigating officer. iv.

The Applicant shall not commit any other crime. 8.

The Anticipatory Bail Application is disposed of in the aforesaid terms.
