Heard Ms. Bhatia, Learned Counsel appearing for the Applicants and Ms. Yadav, Learned APP appearing for the RespondentState.

The Applicants, by the present applications filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("Sanhita") are seeking pre-arrest bail in connection with C.R. No. 526 of 2024, registered with Dighi Police Station, Pimpri-Chinchwad for the offences punishable under Sections 34 and 420 of the Indian Penal Code, 1860.

As per the prosecution case, the first informant has taken insurance policies issued by the ICICI Lombard General Insurance Company, initially for the year 2021, and thereafter, the same are renewed. As per the prosecution case, the accused who are the agents working with ICICI Lombard General Insurance Company have not renewed the policies and fake and fabricated letters and policies have been given to the first informant. However, during the course of investigation, it was found that the policies which are issued to the first informant are genuine.

Thus, in the facts and circumstances of the case, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:

O R D E R

a) In the event of arrest of the Applicants, namely, Sanjay Kalika Mishra, Rohit Kumar Mishra and Naveen Kumar Mishra, in connection with C.R. No.- 526 of 2024, registered with Dighi Police Station, Pimpri-Chinchwad, the Applicants are directed to be released on bail on their furnishing P.R. Bond in the sum of Rs.10,000/-, each, with one or two solvent sureties in the like amount.

b) The Applicants shall attend the concerned Police Station as and when called by the concerned investigating officer and shall cooperate with the investigation.

c) The Applicants shall furnish their cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

d) The Applicants shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

e) The Applicants shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

f) The Applicants shall not leave India without prior permission of the concerned Trial Court/Sessions Court.
