Heard Mr. Adkine, learned Counsel appearing for the Applicant and Mr. Mangaonkar, learned APP for the State. 2.
By this application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant is seeking pre-arrest bail in connection with C.R. No.491 of 2024 registered with Bhosari MIDC, Pimpri-Chinchwad Police Station, for the offences punishable under Sections 318(4) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 ("BNS"). In the Charge-sheet filed, Section 316(2) of BNS is added.

The Applicant is Accused No.5. As per the case of the prosecution, Accused No.3- Anurag Pradip Naik, Accused No.4Shridhar Suresh Khede and Accused No.6 - Mahesh Jadhav are the Directors of Grand Emirates Private Limited ("Said Company"). The Applicant was working in the said Company as Relationship Manager. As per the prosecution case, Applicant i.e. Accused No.5 used to explain to various customers that the Company is offering holiday tour packages and by payment of only Rs.1,35,000/-, travel of 35 days all over India within a period of 5 years was being offered, the First Informant has invested an amount of Rs.1,35,000/- and another person has invested certain amount. 4.
It is the submission of Mr. Adkine, learned Counsel for the Applicant that the Applicant is not involved in the crime and he is merely working in the said Company as Relationship Manager. He submits that the main Director i.e. Mr. Anurag Pradip Naik has been arrested and he has been released on bail. He submits that the Charge-sheet is also filed. He submits that there is no other antecedents.

On the other hand, Mr. Mangaonkar, learned APP strongly opposes the Application. He submits that there are total 9 Accused,
out of which 5 Accused have been arrested and 3 have been granted regular bail, and two are still in Jail. He submits that main Accused i.e. Accused No.4 - Shridhar Suresh Khude and Accused No.6- Mahesh Jadhav i.e. other Directors of said Company are still absconding. He submits that as far as the present Applicant is concerned, an amount of Rs.5,000/- and Rs.59,000/- have been deposited in his account and therefore the Applicant is involved in the crime. He submits that about 19 persons have been cheated by the Accused. He further submits that the Applicant was absconding. The Charge-sheet is only filed against the Accused who has been arrested and not against other Accused including the Applicant who was also absconding.

Mr. Adkine, learned Counsel for the Applicant submits that the Applicant was not absconding and he has filed Anticipatory Bail Application before the learned Trial Court and same has been dismissed. He submits that the amounts which are deposited in his account are as per the direction of the Directors of said Company. He submits that the Applicant is not involved in the crime. He submits that his account is already freezed.

Perusal of record shows that the Applicant was working as Relationship Manager in the said Company. The Directors are
Accused Nos. 3, 4 and 6. Accused No. 3 has been arrested and released on regular bail, Accused Nos. 4 and 6 are absconding. The Charge-sheet is already filed against arrested Accused. Thus, the investigation is almost completed.

As far as the Applicant is concerned, he was working with the said Company as Relationship Manager.

Mr. Mangaonkar, learned APP is right in contending that the Applicant is also involved in the crime. However, the Applicant was not the Director of the Company and merely working as Relationship Manager.

Perusal of record shows that the Applicant is also involved in the crime and amounts of Rs.5,000/- and Rs.59,000/- have been deposited in his account. However, the said account is already freezed.

Mr. Adkine, learned Counsel for the Applicant states that the Applicant will co-operate with the investigation and will comply with all terms and conditions. Accordingly, in the facts and circumstances, the case is made out for grant of anticipatory bail to the Applicant. Hence, following Order is passed:
O R D E R
(i) In the event of arrest, the Applicant - Mayur Dattatray Thange be released on bail in C.R. No.491 of 2024 registered with Bhosari MIDC, Pimpri-Chinchwad Police Station, on executing P.R. bond of Rs.50,000/- and furnishing one or two sureties in the like amount. (ii) The Applicant shall attend the concerned Police Station on 10th December 2025, 11th December 2025 and 12th December 2025 between 11.00 a.m. to 2.00 p.m. and thereafter as and when called by the Police and shall co-operate with the investigation.
(iii) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(iv) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade
such a person from disclosing the facts to the Court or to any Police personnel.
(v) The Applicant shall not leave India without prior permission of the Court.
(vi) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.

The Anticipatory Bail Application is allowed and disposed of accordingly.
