Heard Mr. Ugle, learned Counsel appearing for the Applicant and Ms. Newton, learned APP for the State.

By this application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant is seeking pre-arrest bail in connection with C.R. No.842 of 2025 registered with Hinjawadi Police Station, Pimpri-Chinchwad, for the offences punishable under Sections 118(2), 115(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 ("BNS").

The present Applicant is Accused No.2.

As per the prosecution case the First Informant was doing painting work with Accused No.1- Vasant Rathod. Since his

painting work was finished, and he was about to go to his house, at about 7.00 pm., Accused No.1-Vasant Rathod told the First Informant to do other work. When the First Informant has refused to do the same, Accused No.1- Vasant Rathod had called the First Informant on the spot and assaulted him with hockey stick on his head and back and caused grievous injuries on account of refusal of work by him. As far as the role of the present Applicant is concerned, who is Accused No.2, he gave fist blows on the mouth of the First Informant and caused bleeding injury and fall of his teeth and as a consequence caused grievous injury. 5.

Ms. Newton, learned APP strongly opposes the Application. She submits that the First Informant has suffered grievous injury, and therefore the application be rejected.

Perusal of the record shows that the incident in question has taken place as the First Informant has refused to do other work than painting. The only allegation against the present Applicant is that he gave fist blows on the mouth of the First Informant and as a result the First Informant suffered grievous injury. Perusal of the record also shows that the incident has taken place on a minor issue of refusing the work other than doing painting by the First

Informant. Although there is one antecedent, the same is of the year 2021 and the Applicant has been granted bail in that case. 7.

The main accused i.e. Accused No.1- Vasant Rathod has already been granted regular bail by Order dated 27th October 2025 passed by the learned J.M.F.C., Paud, District-Pune. 8.

Accordingly, by imposing conditions, the Application can be granted. Hence, following Order is passed:

O R D E R

(i) In the event of arrest, the Applicant - Mr. Vishal Maruti Jadhav be released on bail in C.R. No.842 of 2025 registered with Hinjwadi Police Station, PimpriChinchwad, on executing P.R. bond of Rs.25,000/- and furnishing one or two sureties in the like amount. (ii) The Applicant shall attend the concerned Police Station on 10th December 2025 and 11th December 2025 between 11.00 a.m. to 2.00 p.m. and thereafter as and when called by the Police and shall co-operate with the investigation.

(iii) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(iv) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(v) The Applicant shall not leave India without prior permission of the Court.

(vi) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.

The Anticipatory Bail Application is allowed and disposed of accordingly.
