This is an application for Anticipatory Bail. 2.
The applicants are apprehending their arrest in Crime No. 998 of 2025 registered at Amboli Police Station, for the offences punishable under Sections 352, 351(2), 191(2), 190, 189(2), 118(2), 115(2) of the Bharatiya Nyaya Sanhita, 2023. 3.
It is the case of the prosecution that on the date of incident, which took place on 18.10.2025 at around 7.00 pm, the first informant, after finishing work, had come to the food stall of applicant No.1 to have his meal. It is alleged that the present 1/4
applicants and other co-accused got annoyed with an act of the first informant of asking rates of the food items and thus assaulted him by fist and kicks blows, sticks, etc.

I have heard the learned counsel for the applicants and the learned APP for the respondent-State.

The learned counsel for the applicants submits that at the time of alleged incident, the first informant was under the influence of liquor. It is submitted that under the influence of liquor, the first informant assaulted the applicants, in respect of which there is a cross FIR. The learned counsel for the applicants submits that there are no other criminal antecedents against the present applicants.

On the other hand, the learned APP for the respondentState submits that the first informant was assaulted on a very trivial issue. It is submitted that the first informant in the alleged incident was treated as an indoor patient for the injuries sustained by him for ten days. It is submitted that considering the nature of crime, the applicants may not be released on anticipatory bail. 2/4

Admittedly, in relation to alleged incident, there is a cross FIR. In the cross FIR, there are allegations of assault by knife. It appears that the applicants were also injured in the alleged incident. There are no other criminal antecedents against the present applicants. Considering the said facts, I am inclined to release the applicants on anticipatory bail. In the result, the following order is passed :
O R D E R
a) The Application is allowed.
b) In the event of arrest of the applicants in connection with Crime No. 998 of 2025 registered at Amboli Police Station, for the offences punishable under Sections 352, 351(2), 191(2), 190, 189(2), 118(2), 115(2) of the Bharatiya Nyaya Sanhita, 2023, the applicants be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- each with one or two sureties in the like amount.
c) The applicants shall attend the concerned 3/4
police station as and when called by the investigating officer and shall co-operate in the investigation.
d) The applicants after filing of the charge-sheet shall attend the concerned police station once in a month I.e on first Saturday between 11:00 am to 2:00 pm., till conclusion of the trial.
e) The applicants shall not commit any other crime.
f) The application is disposed of in the aforesaid terms.
