This application is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking pre-arrest bail in connection with C.R. No.290 of 2023 registered with Sinhgad Road Police Station, Pune, for the offences punishable under Sections 420, 406, 467, 468, 471 read with Section 34 of the Indian Penal Code, 1860 and Sections 3 and 4 of the Maharashtra Protection of Interest of Depositors Act, 1999.

As per the prosecution case, on the pretext that the First Informant and other affected persons would be taken to "Chardham Pilgrimage", huge amount was accepted from several persons and inspite of that, no such trip was arranged. The amount involved in the crime is Rs.35,89,500/-.

It is the submission of Mr. Vagal, learned Counsel appearing for the Applicant that the Applicant is accused No.2. The main role is of accused No.1 who is the husband of the present Applicant. He submits that the main accused i.e. accused No.1 has been granted regular bail by order dated 11th October 2024 passed by the learned Additional Sessions Judge, Pune below Exhibit-4 in Special S.C. No.965 of 2023 as further modified by the order dated 30th January 2025 passed by the learned Single Judge in Criminal Application No.1813 of 2024.

Mr. Vagal, learned Counsel appearing for the Applicant makes voluntary statement that the Applicant will deposit before the concerned MPID Court, Pune, an amount of Rs.3,00,000/- on or before 24th December 2025.

On the other hand, Mr. Karmakar, learned APP strongly opposes the Anticipatory Bail Application. He submits that the

Applicant i.e. accused No.2 is wife of the main accused i.e. accused No.1 and actively helped accused No.1 in committing very serious crime. Therefore, he submits that the Anticipatory Bail Application be rejected.

Perusal of the record shows that the charge-sheet is already filed against the main accused i.e. accused No.1 and charge-sheet under Section 299 of the Code of Criminal Procedure, 1973 is filed against the present Applicant. Thus, the investigation is almost completed. Perusal of the record further shows that the main role is of the accused No.1, to whom regular bail has been granted. The Applicant has made voluntary statement that she will deposit an amount of Rs.3,00,000/- on or before 24th December 2025 before the concerned MPID Court, Pune.

Accordingly, in the facts and circumstances, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant-Supriya Sanket Bhadale in connection with C.R. No.290 of 2023 registered with the Sinhgad Road Police Station, Pune,

the Applicant is directed to be released on bail on her furnishing P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

(b) The Applicant shall attend the Sinhgad Road Police Station, Pune on 11th December 2025 and 12th December 2025 between 11:00 a.m. to 02:00 p.m. and shall cooperate with the investigation.

(c) The Applicant shall attend the Sinhgad Road Police Station, Pune, as and when called by the Investigating Officer.

(d) The Applicant shall comply with voluntary statement made by her to deposit an amount of Rs.3,00,000/- before the concerned MPID Court, Pune on or before 24th December 2025.

(e) The Applicant shall furnish her cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto. (f) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(g) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(h) The Applicant shall not leave India without prior permission of the Court.
