This is an Application for anticipatory bail. MUGDHA MANOJ PARANJAPE 2.
The Applicant is apprehending his arrest in Crime No.1709 of 2025 registered with Mumbra Police Station for the offences punishable under Sections 109, 115(2), 352, 351(3), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that on the date of incident, which took place on 26th October 2025, at about 5.00 p.m. the present Applicant and other co-accused assaulted the first informant with a knife and attempted to commit his murder due to previous enmity between them. Accordingly, the present crime was registered. 4.
I have heard Learned Counsel for the Applicant, Learned APP for the Respondent-State and Learned Counsel for the first informant.

Learned Counsel for the Applicant submits that there is a cross FIR as the Applicant was also assaulted with a knife in the alleged incident. It is submitted that the alleged injury sustained by the first informant is not attributed to the present Applicant.

On the other hand, Learned APP for the Respondent-State and Learned Counsel for the first informant submit that specific overt act is attributed to the present Applicant in the crime in question. It is submitted that the Applicant is involved in one more crime for the offences punishable under Sections 118 and 351 of the BNS. It is submitted that after the registration of the present crime, the Applicant had threatened the first informant to withdraw the same and thus the first informant was compelled to lodge N.C. to that effect. It is further submitted that considering the said facts, the Applicant may not be released on anticipatory bail.

Learned Counsel for the Applicant, on instructions, submits that the Applicant is ready and willing to stay out of Thane. 8.
I have perused the FIR. The injury sustained by the first informant is attributed to the co-accused. There is also a cross FIR in the same crime as the Applicant was also injured in the alleged incident. Considering the overall facts and circumstances of the case, I am inclined to release the Applicant on anticipatory bail, subject to certain conditions. Hence, the following order:-

ORDER
i.
The Anticipatory Bail Application is allowed. ii.
In the event of the arrest of the Applicant in Crime No.1709 of 2025 registered with Mumbra Police Station for the offences punishable under Sections 109, 115(2), 352, 351(3), 3(5) of the Bharatiya Nyaya Sanhita, 2023, he shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or two sureties in the like amount.
iii. The Applicant shall not enter into the municipal corporation limits of Thane till conclusion of the trial. iv.
The Applicant shall not tamper with the prosecution evidence. v.
The Applicant shall not commit any other crime. 9.
The Anticipatory Bail Application is disposed of in the aforesaid terms.
