This is an application for anticipatory bail. 2.
The applicant is apprehending his arrest in Crime No.197 of 2025 registered at Kalyan Taluka Police Station for the offences punishable under Sections 118(2), 115(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that on the date of alleged incident which took place on 8th April 2025, the present applicant and other co-accused persons assaulted the first informant with a knife as well as with fist and kick blows on account of a previous dispute between them. It is alleged that during the said assault the first informant sustained grievous injuries. 1/3

I have heard the learned counsel appearing for the applicant, the learned APP for the respondent / State and the learned counsel for the first informant.

Learned counsel for the applicant and the learned counsel for the first informant jointly submit that parties have amicably settled their dispute and filed the criminal writ petition before this Court seeking quashing of the FIR in-question. It is submitted that there are no other criminal antecedents against the present applicant.

Learned counsel for the first informant submits that the first informant has no objection if the applicant is released on anticipatory bail.

Considering the overall facts and circumstances of the present case, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed.
ORDER
A) The Application is allowed.
B) In the event of arrest of the applicant in C.R. No. 197 of 2025 registered at Kalyan Taluka Police Station for the offences punishable under Sections 118(2), 115(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, he be released on bail on executing P.R. Bond in the sum of Rs.25,000/- with one surety or two sureties in the like amount.

C) The applicant and the first informant shall pay cost of Rs.20,000/- to the Police Welfare Fund, Thane within a period of four weeks from today.
