Heard Mr. Kale, learned Counsel appearing for the Applicant and Mr. Karmakar, learned APP for the State.

By this application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant is seeking pre-arrest bail in connection with C.R. No.227 of 2025 registered with Baner Police Station, Pune City, for the offences punishable under Sections 25, 4 of the Arms Act, 1959, under Sections 109(1), 3(5) of the Bharatiya Nyaya Sanhita, 2023 ("BNS") and under Section 135 and 37(1) of the Maharashtra Police Act, 1951.

As per the prosecution case, as some dispute has occurred earlier and to resolve the said dispute, the First Informant, his friends and the Accused had a meeting and while resolving said dispute, altercations took place and Accused persons assaulted the First Informant.

It is the submission of Mr. Kale, learned Counsel for the Applicant that there are total 4 accused named in the F.I.R.. The Applicant is Accused No.2. The only role attributed to the Applicant is that he has abused the First Informant and assaulted the First Informant by hand. He submits that the Applicant is a student of 18 years and has no antecedents. He submits that the Applicant will co-operate with the investigation. 5.
On the other hand, Mr. Karmakar, learned APP strongly opposes the Application. He submits that the Applicant was present when the incident had taken place and participated in the crime. On instructions, he submits that the Applicant has no antecedents. 6.
Perusal of record shows that the incident in question took place as the First Informant, his friends and all accused had a meeting to resolve earlier dispute. The only role attributed to the
present Applicant is that he was present when the incident took place and he assaulted the injured with hand. Although the First Informant has suffered grievous injury, the Applicant is not concerned with the same. The Applicant is a student of 18 years. There are no antecedents.

Accordingly, by imposing conditions, the Anticipatory Bail Application can be granted. Hence, following Order is passed:
O R D E R
(i) In the event of arrest, the Applicant- Bajrang alias Durgesh Ganesh Patil be released on bail in C.R. No.227 of 2025 registered with Baner Police Station, Pune City, on executing P.R. bond of Rs.25,000/- and furnishing one or two sureties in the like amount. (ii) The Applicant shall attend the concerned Police Station as and when called by the Police and shall cooperate with the investigation. (iii) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and
shall keep the same updated, in case of any change thereto.
(iv) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(v) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.

The Anticipatory Bail Application is allowed and disposed of accordingly.
