This is an application for Anticipatory Bail. 2.
The applicants are apprehending their arrest in Crime No. 758 of 2025 registered at Nirmal Nagar Police Station, for the offences punishable under Sections 118(1), 118(2), 115(2), 352 & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that on 19.10.2025 at around 7.45 pm, for no reason, the present applicants and other co-accused assaulted the first informant and his cousin by iron rod and knife. It is alleged that due to the assault, the first informant and his cousin sustained grievous injuries.

I have heard the learned counsel for the applicants and the learned APP for the respondent-State.

The learned counsel for the applicants submits that in the alleged incident, the applicants were also assaulted and thus there is a cross FIR in that respect. The learned counsel for the applicants further submits that the applicants will stay out of the jurisdiction of Nirmal Nagar Police Station till conclusion of the trial.

On the other hand, the learned APP for the respondentState submits that the custodial interrogation of the applicants is necessary to recover the weapons. It is submitted that the applicants are involved in one more crime for the offence punishable under Section 326 of the Indian Penal Code. It is submitted that, considering the said facts, the applicants may not be released on anticipatory bail.

Admittedly, there is a cross FIR relation to the alleged incident. The fact that the applicants were also injured in the alleged incident is not disputed. Considering the overall facts and 2/3
circumstances, I am inclined to release the applicants on anticipatory bail. In the result, the following order is passed :
O R D E R
a) The Application is allowed.
b) In the event of arrest of the applicants in connection with Crime No. 758 of 2025 registered at Nirmal Nagar Police Station, for the offences punishable under Sections 118(1), 118(2), 115(2), 352 & 3(5) of the Bharatiya Nyaya Sanhita, 2023, the applicants be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- each with one or two sureties in the like amount.
c) The applicants shall not enter into the jurisdiction of Nirmalnagar police station till conclusion of the trial, except to attend the dates before the trial Court.
