The present Application is preferred by the Applicant seeking pre-arrest bail in connection with the offence registered under C.R. No.1581 of 2025 with the V.P. Road Police Station, Girgaon, Mumbai for the offence punishable under Section 316(5) of the Bhartiya Nyaya Sanhita, 2023 (for short "BNS") . 3.

The sum and substance of the Prosecutions case is that that the Accused has cheated the Complainant to the tune of Rs.2,44,33,436/-. The Prosecution's case is that, the Complainant believed upon the Accused and transferred the amount to certain companies. On 24th January, 2025, the Complainant received a notice from GST office. At that time, the Complainant noticed that he was cheated by the Accused.

Mr.Jha, learned counsel for the Applicant states that no element of Section 316 (5) of BNS is attracted in this case. He states that interim protection may be granted to him. 5.

Learned APP appearing for the Respondent - State 2/4

seeks time to file affidavit in reply. Mr.Himanshu Indise, learned counsel seeks to intervene in this matter. He seeks time to file affidavit.

I have perused the papers. The FIR in question is registered on 5th November, 2025 under Section 316(5) of BNS. The date of occurrence of incident is stated to be from 18th August, 2022 till 20th August, 2024. Prima-facie, it appears to be the transaction where the Complainant himself has received certain benefits, it is only after GST office questioned him, that the present FIR is filed. In any event, custodial interrogation of the Accused is not necessary. The offence in question can be investigated by the Respondent - State by perusing the papers. 7.

Since the learned APP as well the learned advocate for the Respondent require time to file affidavit in reply, at their request stand over to 13th January, 2026. The following order is passed :

i).

In the event of the Applicant being arrested in connection with the C.R. No.1581 of 2025, registered with V.P. Road Police Station, Girgaon, Mumbai under Section 316(5) of BNS, he be released on bail on executing a PR Bond of Rs.50,000/- with one or more sureties in the like amount.

ii).

The Applicant to attend the concerned Police Station on 6th January, 2026 to 8th January, 2026 from 10:00 a.m. to 02:00 p.m. 8.

Place the Application for further consideration on 13th January, 2026.
