Heard Mr. Ghag, learned Counsel appearing for the Applicant, Ms. Yadav, learned APP for the Respondent-State and Mr. Mehta,
learned Counsel appearing for the Intervenor. 2.
After hearing the matter for some time, this Court expressed that the offence is very serious and therefore the Applicant is not entitled for Anticipatory Bail.

However, Mr. Ghag, learned Counsel appearing for the Applicant submits that although Anticipatory Bail Application No.3557 of 2025 and Anticipatory Bail Application No.3561 of 2025 have been rejected by this Court by Order dated 23rd December 2025, the Applicants in those Applications are not yet arrested. He points out Paragraph No.16 of the said Order dated 23rd December 2025, wherein this Court has observed that Applicant No.1 - Vikas Bharat Gogawale in Anticipatory Bail Application No.3557 of 2025 is the son of Cabinet Minister of the State of Maharashtra, the Applicant No.2 - Mahesh Nivrutti Gogawale in said Anticipatory Bail Application is the nephew of said Cabinet Minister of the State of Maharashtra and as far as Applicant Nos.1 to 4 in Anticipatory Bail Application No.3561 of 2025 are concerned, they are close relatives of the said Cabinet Minister. Thus, the Applicants in those Anticipatory Bail Applications are very influential and they have not yet been arrested.

In view of said contention raised by learned Counsel appearing for the Applicant, Mr. Mehta, learned Counsel appearing for the Intervenor i.e. Mahesh Nivrutti Gogawale i.e. son of the Cabinet
Minister of the State of Maharashtra points out Order dated 23rd December 2025 passed in Anticipatory Bail Application No.3559 of 2025 and submitted that although said Application has been dismissed, the Applicants in said Applications have not been arrested. He submits that the Applicant No.2 in said Anticipatory Bail Application No.3559 of 2025 is the brother of ex-MLA and other Applicants are also very influential and they have also been not arrested. 5.
Both the learned Counsel state that the said Orders dated 23rd December 2025 are not challenged.

In view of these submissions, learned Advocate General is requested to appear in the matter as the above position is very serious and affects the administration of justice as also the rule of law. 7.
Accordingly, stand over to 17th January 2026. To be shown 'First on Board' at 03:00 p.m..
