Heard Mr. Andhale, learned Counsel appearing for the Applicant and Mr. Mangaonkar, learned APP for the RespondentState of Maharashtra. 2.
By the present Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant is seeking pre-arrest bail in connection with CR No.608 of 2025 registered with the Pimpri Police Station, Pimpri Chinchwad, Pune, for the offences punishable under Sections 318(4), 335, 340(1) and 340(2) of the Bharatiya Nyaya Sanhita, 2023.

It is the main submission of Mr. Andhale, learned Counsel for the Applicant that, in the FIR the Applicant's name is not mentioned. He submits that only during investigation and on the basis of the statement of Accused No.1 the Applicant is added as Accused. He submits that the Applicant has no role to play in the crime. The Applicant is a student. There are no other criminal antecedents against the Applicant.

On the other hand, Mr. Mangoankar, learned APP, strongly opposes the Anticipatory Bail Application. He submits that the offence is very serious, wherein a forged birth certificate of Accused No.1 has been submitted to the Passport Authority. He therefore submits that the Anticipatory Bail Application be rejected. However, on instructions, he submits that the Applicant has no antecedents.

As per the prosecution case, Accused No.1-Firdos Begum Kudartullah Syed had submitted an application to the Passport Authority for issuance of passport and along with the said application a birth certificate was produced. At the time of verification of the said birth certificate it was found that the same
was the forged certificate. During investigation, the prosecution came to know that the said forged birth certificate was procured by said Firdos Begum Kudartullah Syed from the present Applicant. The main Accused is the aunt of the present Applicant. 6.
There is substance in the contention of Mr. Mangaonkar, learned APP, that the offence is very serious. However, the Applicant is a student.

Mr. Andhale, learned Counsel for the Applicant, submitted that the Applicant will cooperate with the investigation. There are no other antecedents against the Applicant.

Accordingly, by imposing conditions, the Anticipatory Bail Application can be granted.

In view thereof, the following Order is passed:
O R D E R
(a) In the event of arrest of the Applicant - Sayyed Faizan Sayyed Fayyaz, in connection with CR No.608 of 2025 registered with the Pimpri Police Station, Pimpri-
Chinchwad, Pune, he be released on bail on his furnishing PR Bond in the sum of Rs.50,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the concerned Police Station on 12th January 2026 and 13th January 2026 between 11:00 am to 02:00 pm and thereafter once in a week i.e. every Sunday between 11:00 am to 02:00 pm, till filing of the Charge-sheet and shall cooperate with the investigation.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the
Complainant or any witness in any manner.
(f) The Applicant shall not leave India without prior permission of the Court.
