It is argued that while filing the charge-sheet for the offene punishable under Section 188 of the Indian Penal Code, the procedure as contemplated under Section 195 of Code of Criminal Procedure has not been followed, and therefore, the whole proceedings vitiates. 3.

Issue notice to the non-applicants, returnable on 21.04.2025. Learned Addl.Public Prosecutor waives service of notice on behalf of the non-applicant/State. 4.

In addition to regular mode of service, the applicant is permitted to serve non-applicant no.2 by private mode.

In the meantime, there shall be stay in terms of prayer clause (b) of the petition.
