The applicant has filed this application for quashing the Charge-sheet arising out of the First Information Report No. 06/2022 registered for the offence punishable under Section 498-A of the Indian Penal Code and Regular Criminal Case No.745/2022 pending before the 4th Joint Civil Judge Junior Division and Judicial Magistrate First Class, Chandrapur.

Learned Counsel for the applicant has stated that, the offences against all the family members of the applicants have already been quashed and set aside. During the pendency of the matter, the parties have settled their dispute and have filed a petition for divorce by mutual consent. The applicant has handed over a Demand Draft of Rs. 5,51,000/- to non-applicant No. 2.

As per the consent terms, non-applicant No. 2 has agreed to give her no objection for quashing and setting aside the First Information Report against the applicant.

Non-applicant No. 2 is present through video conferencing and has been duly identified by her learned Counsel. She states that she has no objection to quash and set aside the First Information Report, Charge-sheet, and the proceedings pending before the learned Magistrate. 5.
The matter is settled between the parties. Nonapplicant No.2 has no grievance against the applicant. Hence, the Charge-sheet arising out of the First Information Report No. 06/2022 registered for the offence punishable under Section 498-A of the Indian Penal Code and Regular Criminal Case No.745/2022 pending before the 4th Joint Civil Judge Junior Division and Judicial Magistrate First Class, Chandrapur are quashed and set aside subject to depositing costs of Rs.20,000/- paid by the applicant and the non-applicant No.2 each with the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur bearing Account No.129712010001014 and IFSC Code UBIN0812978 within a period of four weeks and producing the receipt thereof on record within two weeks thereafter.

The application is allowed in the above terms and disposed of.
