The present Application is preferred by the Applicant for quashing of the FIR in connection with Crime No.893/2024 registered with Police Station, Khadan, District Akola under Sections 74 and 351(2) of the Bhartiya Nyaya Sanhita, 2023.

The crime is registered against the Applicant on the basis of the report lodged by the Informant/Non-applicant No.2 on an allegation that she was serving in Dr. Babasaheb Ambedkar Journalism and Social Work Mahavidyalaya Khadki, Akola and the present Applicant was the ex-trustee of said Institution. There was a dispute between the other trustees and the present Applicant, and therefore, he is

Learned Counsel for the Applicant, submitted that the nature of the allegation is that the present Applicant has called her and outraged her modesty, however baseless and false allegations are levelled only out of the dispute between the trustees and the present Applicant.

During the pendency of this Application, both the parties arrived at a settlement and the present Applicant has already tendered his resignation as a trustee and they have also filed a joint affidavit in support of their contentions and now the Non-applicant No.2 has no grievance against the present Applicant, and therefore, the FIR deserves to be quashed and set aside.

The Applicant and Non-applicant No.2 are present before the Court. We have verified the contents of the affidavit from them. The Non-applicant No.2 specifically stated that they have decided to settle the dispute amicably. Now, the Applicant has also resigned from the trust and now she has no grievance against him. In view of that, she has no objection for quashing of the FIR. She is identified by the learned Counsel Mr. Shrikant Reddy.

Though allegations are levelled against the present Applicant as to the outraging the modesty but considering the recitals of the FIR and the submissions made by the learned Counsel for the Applicant there appears to be some substance in the contention and now parties have

Though the offence is non-compoundable one but considering now the Applicant has already resigned from the trust and the grievances are already settled between the parties nothing is survived even forcing the Applicant to face the Trial and it would be a futile exercise. In view of that, the Application deserves to be allowed. Accordingly, we proceed to pass the following order.
O R D E R
i.
The Application is allowed.
ii.
The First Information Report bearing Crime No.893/2024 registered with Police Station, Khadan, District Akola under Sections 74 and 351(2) of the Bhartiya Nyaya Sanhita, 2023, is hereby quashed and set aside to the extent of present Applicant.

Pending application/s, if any, shall stand disposed of accordingly.
