The applicant is seeking stay to the proceedings before the MPID Court as the matter is fixed for framing of charge.

The learned counsel for the applicant has stated that the name of applicant was not mentioned in FIR but added along with the charge-sheet. There are three main accused. This Court has passed the order against the other co-accused not to frame charge under MPID Act against them.

The Crime No.783/2023 is registered with the Mouda Police Station, Nagpur Rural for the offences punishable under Sections 109, 120-B, 409, 413, 420, 467, 468, 471 of the Indian Penal Code and Section 3 of the Maharashtra Protection of the Depositors Act, 1999 (the MPID Act). As MPID Act would not be attracted as there is

apl693.25.O.odt no involvement of financial institution or deposit of money to the applicant on assurance of payment. By the interim order, the proceedings before the trial court of framing of charge is stayed till next date.

The order of stay is already passed on 29.08.2024 against other co-accused.

Issue notice to the non-applicants, returnable on13.06.2025.
