There are no other averments as to the fact that, the applicant was incharge of and was dealing with the day-to-day affairs of the company. However, without considering this aspect, the process was issued, and prayed for the stay to the further proceedings of the criminal complaint. 3.

Learned APP waives service of notice and seeks time to file reply.
