The applicant has filed the present application for quashing and setting aside the Charge-sheet being Sessions Trial No.243 of 2018 and the First Information Report No.245 of 2018 registered with Police Station, Bor, Nagpur, for the offence punishable under Sections 376(2)(n),506 and 496 of the Indian Penal Code.

The allegations against the applicant are that he and the informant were in a relationship and on speaking terms. It is alleged that the applicant established sexual relations with the informant and subsequently extended threats to her, pursuant to which the present offence came to be registered.

It is submitted that the matter has now been amicably settled between the parties. Non-applicant No. 2 (the informant) is present before the Court through video conferencing, and her father is also personally present before the Court. Non-applicant No.2 has stated that she is now married and has a child, and she does not wish to prosecute the matter any further.

A joint pursis has been filed by the parties, which is taken on record and marked as Exhibit "X" for identification. The father of the complainant has also stated that she does not wish to proceed with the case and has no objection for quashing of the charge-sheet being Sessions Trial No. 243 of 2018 and First Information Report No. 245 of 2018 registered at Police Station Bor, Nagpur, for offences punishable under Sections 376(2)(n), 506, and 496 of the Indian Penal Code.

As the non applicant No.2 is not ready to proceed further with the matter and have no objection, the Chargesheet being Sessions Trial No.243 of 2018 and the First Information Report No.245 of 2018 registered with Police Station, Bor, Nagpur, for the offence punishable under Sections 376(2)(n), 506 and 496 of the Indian Penal Code are hereby quashed and set aside, only subject to the applicant depositing Rs.20,000/- with the Public Welfare
3 / 3 36-apl 844-25 Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur bearing Account No.129712010001014 and IFSC Code UBIN0812978 and producing the receipt thereof on record within two weeks.
6. The application is allowed in the above terms and disposed of.
7. Fees of the learned appointed Advocate for the non applicant No.2 be paid as per rules.
