By this application, the applicant is challenging the order of issuance of warrant against the present applicant. It is submitted by the learned counsel that he has already deposited the amount towards the arrears of two years. In fact, in view of Section 125(3) of the Code of Criminal Procedure, 1973, the application for recovery cannot be filed for the period beyond one year.

Issue notice to non-applicant, returnable after four weeks.

In the meantime, arrest warrant issued by Family Court No.2, Nagpur is stayed till appearance of the non-applicant.
