It appears that the applicants have issued communication to Tahsildar, Armori alleging their grievance, with a threat that if the grievance is not resolved, they will commit suicide. 3.
The letter was apparently not acted upon and, therefore, the applicants consumed a drug namely Avil-50. They were thereafter brought to the office of Tahsildar in unconscious state of mind. Their father informed Tahsildar that because of his inaction, his sons have consumed the drug. Accordingly, First Information Report came to be filed under Section 309 and 186 of the Indian Penal Code, 1860 vide Crime No.207/2021.

Investigation culminated into filing of charge-sheet under Section 186 of the IPC.

Argument is that the Magistrate could not have taken cognizance of the offence being barred under Section 195 of the Criminal Procedure Code, 1973. In support, applicants have relied upon judgment of of the Supreme Court in B. N. John Vs. State of U.P. and another; 2025 SCC OnLine SC 7.
