The applicants have filed this application for quashing of Miscellaneous Criminal Case No.36/2025 pending before the J.M.F.C. Court, Narkhed filed under the Domestic Violence Act. 2.

The applicants have stated that J.MF.C., Narkhed has no jurisdiction to entertain the domestic violence proceedings as the applicants and non-applicant are staying in Nagpur. They stayed together at Nagpur. The cause of action for filing the proceedings is at Nagpur. There is no question of filing proceedings before the Narkhed Court. The objection was raised before the J.M.F.C. Court but Court has stated that it will be decided along with proceedings. Hence, the applicants have raised objection before this Court about the maintainability of the proceedings before Narkhed Court on the ground of jurisdiction.

Notices are already issued but the non-applicant has not appeared. 4.

The proceedings before the J.MF.C. Court, Narkhed are stayed till next date of hearing.
