The charge-sheet filed in the year 2018 is being challenged in the year 2025. We requested learned Additional Public Prosecutor (A.P.P.) to take instructions as to who is responsible for the delay in trial. Learned A.P.P. has taken instructions. He submits that it is the applicant, who is responsible for the delay in trial.

Learned Counsel for the applicant submits that the applicant is not responsible for the delay. He submits that the applicant may be absent for few days but it is not the applicant because of whom, the charge has been not framed or trial has not commenced.

We would like to examine the issue.

The trial Court viz. 14 th Joint Civil Judge Junior Division and Judicial Magistrate First Class, Nagpur shall file report as regards status of the trial and the reasons for the delay in trial. The report shall be filed by 30-8-2025.
