SEPTEMBER 24, 2025 The learned A.P.P. submits that chargesheet is filed and cognizance taken.

2] That being so, remedy under Article 226 of the Constitution of India will not be available to the petitioner.

3] The petition, however, has been filed also under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short "B.N.S.S.").

4] The learned Counsel for the petitioner submits that he will pursue remedy under Section 528 of the B.N.S.S.

5] Permission is granted. The petition shall be treated as an application under Section 528 of the B.N.S.S.

6] The Registry shall list the application before the appropriate Bench.
