The petitioner has filed this petition under Article 226 of the Constitution of India and Section 482 of the Code of Criminal Procedure, 1973.

Learned APP makes a statement that the chargesheet is already filed and cognizance is taken by the Court. In view of that, remedy under Article 226 of the Constitution of India is not available to the petitioner.

The petitioner may take recourse to the remedy under Section 482 of CRPC, 1973 (Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023).

The petition be treated as application under section 482 of the CRPC, 1973 (Section 528 of the BNSS, 2023).
