Heard learned counsel for applicants; learned APP for non-applicant No.1/State, and learned counsel Mrs.P.M.Chandekar for non-applicant No.2. Admit. Heard finally by consent.

By this application, applicants are seeking quashing of FIR in connection with Crime No.830/2022 registered for offence under Section 498-A read with 34 of the IPC and consequent proceedings arising out of the same bearing chargesheet No.180/2023 and RCC No.3808/2021 pending before learned Chief Judicial Magistrate, Nagpur. 4.
The crime is registered on the basis of a report lodged by non-applicant No.2 on allegation that her marriage was performed with applicant No.1 and after the marriage, she resumed cohabitation at her matrimonial house, but she was .....3/-
not treated well and she was subjected for ill-treatment by all applicants for one or the other reason.
On the basis of the said report, the police have registered the crime.

After completion of investigation, chargesheet came to be filed against applicants. They have preferred this application for quashing of the FIR.

During pendency of this application, both applicants and non-applicant No.2 settled the matter before the Mediator. The Mediation Report is before this court. 7.
The parties are personally verified by me and they have accepted and agreed terms and conditions of the settlement.

The Hon'ble Apex Court in the case of Gian Singh vs. State of Punjab and anr, reported in (2002) 10 SCC 303 observed that "where High Court quashes a criminal .....4/-
proceeding having regard to the fact that dispute between the offender and victim has been settled although offences are not compoundable, it does so as in its opinion, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor".

In the present case, the dispute is of matrimonial nature. Now, the parties have already settled the dispute and decided to resolve the marriage.

In view of that, the application deserves to be allowed. Accordingly, I proceed to pass following order:
ORDER
(1) The criminal application is allowed.
(2) The FIR in connection with Crime No.830/2022 registered for offence under Section 498-A read with 34 of the IPC and .....5/-
consequent proceedings arising out of the same bearing chargesheet No.180/2023 and RCC No.3808/2021 pending before learned Chief Judicial Magistrate, Nagpur are hereby quashed and set aside to the extent of present applicants. Application stands disposed of.
