In view of the judgment of the Apex Court in M/s. Celestium Financial vs. A. Gnanasekaran Etc., 2025 SCC Online 1320, the learned counsel appearing for the Applicant/Appellant seeks leave of this Court to withdraw the Application with liberty to file Appeal before the Sessions Court under proviso to Section 372 of the Code of Criminal Procedure, 1973.

The Application/Appeal is permitted to be withdrawn with liberty as prayed for. If the Appeal is filed within a period of four weeks, the objection of limitation in filing the Appeal shall not be raised.
