Heard learned Advocate for the Applicant-Complainant. Leave is sought to prefer an appeal against the judgment of acquittal in two separate cases. Recently, the Hon'ble Supreme Court in the case of M/s. Celestium Financial v/s. A.Gnanasekaran etc.1 held that Complainant falls within the definition of 'victim' and as such appeal can be preferred as per the proviso to Section 372 of Cr.P.C. 2.
In that eventuality, leave is not required but appeal needs to be filed before the Sessions Court.

Hence, this application is disposed of. Liberty granted to the Appellant to approach the Court of City Civil Court. If there is a delay in filing appropriate proceedings, let learned Judge to consider the prayer for delay condonation positively.
