1) The learned counsel appearing for the Applicant seeks leave of this Court to withdraw the appeal in view of judgment of Celestium Financial V/s. A. Gnanasekaran Etc.1 He would also seek liberty to file appeal against the acquittal order under Proviso to Section 372 of the Code of Criminal Procedure, 1973 before the Sessions Court. Reserving the liberty as prayed for, the Appeal is permitted to be withdrawn and disposed of .
