This Interim Application seeks modification of the order dated 18th November 2025 passed by this Court, by which Criminal Application No.1266 of 2025 was allowed and proceedings arising out of the FIR No.1073 of 2023 registered with the Hinjewadi Police Station, Pune were quashed by the consent of the parties.

Mr. Nikhil Hire, the learned counsel for the applicants submits that inadvertently the applicants did not mention section 1/2 65-IA-10-2026.doc Dixit
313 of the Indian Penal Code in the prayer clause, although paragraph no.1 of the criminal application refers to the same. He therefore seeks modification of the order to incorporate section 313 of the Indian Penal Code in prayer clause (a). Ms. M.M. Deshmukh, the learned Public Prosecutor and Mr. Aadesh Konde Deshmukh, the learned advocate for the respondent no.2 have no objection to the modification sought for by the applicants. 3.
Having perused the record and since the applicants admit to the inadvertent typographical error in the prayer clause (a), the order dated 18th November 2025 is modified by consent of the applicants and the respondent no.2. Prayer clause (a) as recorded in the order dated 18th November 2025, stands modified to include section 313 of the IPC and the revised prayer clause (a) shall read as under:

This Hon'ble Court may please to quash and set aside the proceedings arising out of the FIR No.1073 of 2023 for offences under sections 498A, 313, 323, 504, 506, 427 of IPC, registered with the Hinjewadi Police Station, Pune on such terms and conditions this Hon'ble Court may deem fit and proper."

Interim Application No.10 of 2026 stands disposed of in the above terms.
