This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail in connection with C.R. No.285 of 2024 registered with Adgaon Police Station, Nashik, for the offences punishable under Sections 377, 498A, 504, 506, 406 read with Section 34 of the Indian Penal Code, 1860.

The First Informant in C.R. No.285 of 2024 is wife of the present Applicant. As both the learned Counsel for the Applicant and the Respondent No.2 submitted that efforts can be made to resolve the dispute and therefore, by consent of the parties, Mr. Drupad S. Patil, learned Counsel has been appointed as Mediator. With the efforts of Mr. Drupad S. Patil, learned Mediator the dispute is settled in terms of the Consent Terms dated 18th November 2025 and thereafter, certain modifications have also been agreed between the parties on 24th November 2025. The agreed Consent Terms between the parties read as under: "i. Husband shall pay Rs. 10,00,000/- immediately. ii. Husband shall pay remaining Rs. 10,00,000/- in equally monthly installments of Rs. 40,000/-
payable on or before 5th day of each month from December 2025.
iii. In pending Divorce Petition, the application for Divorce by consent shall be filed and Divorce Decree shall be obtained within four weeks, by seeking waiver of judicial separation/ cooling period. iv. The criminal cases shall be withdrawn within four weeks by wife.
v. Husband and his parents shall file quashing petition and wife shall consent for quashing. vi. Default in payment of monthly installment would amount to contempt of High Court."

The above terms are modified as follows:- "1. The parties agree, confirm and declare that the Applicant shall pay an amount of Rs.10 lakh immediately on the disposal of Anticipatory Bail Application No.3472 of 2024.
2. The remainder amount of Rs.10 lakh shall be paid as follows by Demand Draft:-"
a. Rs.5 lakh on the date of order of Quashing of F.I.R. No.285 of 2024 [1. WP/6083/2024 2. WP/6199/2024].
b. Rs. 5 lakh on grant of Divorce Decree by Ld. Family Court, Nashik.
3. The first installment of Rs.10 lakhs shall be paid in Acount No.0240108026816 of Canara Bank, Branch Nashik City (Main Branch) which is a Joint Account of Priyanka Ashok Pawar and Ashok Uttam Pawar (father of Respondent).
4. The parties shall endeavour to obtain Order of Quashing of F.I.R. from Hon'ble Bombay High Court within a period of 1 week from today.
5. After obtaining the Quashing Order, the parties shall procure Decree for Divorce by Mutual Consent within a period of 1 month from the date of Quashing Order in WP/6083/2024 and WP/6199/2024.
6. Both parties shall withdraw all Civil/Criminal Cases filed by them and/or their family members/relatives against the other party or their family members/relatives.
7. Both parties undertake not to file any further complaints/cases/Litigation of any nature against each other.
8. Both parties declare all pending disputes between the parties are fully resolved and there are no future claims against each other. Parties further declare that all claims are satisfied as per the present terms."

Thus, as the Respondent No.2-Wife has agreed to withdraw the complaint in view of the agreed terms and conditions and as a learned Single Judge has already granted interim protection by
order dated 10th February 2025, which is in operation till date, the case is made out for grant of Anticipatory Bail. 6.
In view thereof, the following order is passed:
O R D E R
(a) In the event of arrest of the Applicant-Vishal Vitthalrao Hande in connection with C.R. No.285 of 2024 registered with the Adgaon Police Station, Nashik the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.10,000/- with one or two sureties in the like amount.
(b) The Applicant shall attend the Adgaon Police Station, Nashik as and when called.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not tamper with the prosecution evidence.

The Anticipatory Bail Application is disposed of accordingly. 8.
In view of the disposal of the Anticipatory Bail Application, nothing survives in the Interim Application and the same is also disposed of.
