This is an application for condonation of delay of 1 year and 73 days in filing Appeal against the Judgment and Order dated 21/10/2023 passed by the Special Judge, Kolhapur, in Special Case No.139/2021.

Learned counsel for the Applicants submitted that, they were poor agriculturists. They were in bad financial condition. MANUSHREE NESARIKAR They could not arrange to engage an Advocate earlier. Learned APP opposed this application. According to him, the delay is inordinate. The Applicants were on bail. Therefore, nothing stopped them from filing the Appeal earlier. 4.
I have considered these submissions. The sentence imposed is only to pay a fine of Rs.1,000/-. As submitted by learned counsel for the Applicant they are from poor financial background.

Considering these submissions and in the interest of justice, the delay of 1 year and 73 days in filing the Appeal is condoned.

The Appeal be processed further.

The Application is disposed of.
