CORAM

: SHIVKUMAR DIGE, J.

DATED : 3rd APRIL, 2025.

P. C. :

1.

By this application, the applicant is seeking relaxation of bail condition imposed by this Court (Coram: N.R.Borkar, J.) by order dated 12.02.2024. 2.

Learned counsel for the applicant submits that by order dated 12.02.2024, this Court in paragraph No.10 (C), has directed that "The applicant after his release shall stay outside Pune District and shall not enter into the limits of District Pune till conclusion of trial, except to attend the dates before the trial Court." Learned counsel for the applicant submits that applicant's family stays in Pune. He is staying outside of Pune since year 2023, hence requested to allow the application.

3.

Learned APP strongly objected to allow the application on the ground that 1/2

S.S.KIlaje 62-IA-283-2025 (CR).doc offence under Section 302 of Indian Penal Code is registered against the applicant, hence requested to reject the application. 4.

I have heard both the learned counsel. Considering the submission of both the learned counsel, as well as chargesheet is filed against the applicant and he is attending the Court dates regularly, as also his family stays in Pune, I pass following order.

ORDER

(a) Condition No. 10 (C) of the Order dated 12.02.2024 is hereby relaxed.

5.

Interim Application is disposed of.
