We have heard the learned Advocate for the Petitioners. 2.
The learned Addl. PP submits that the chargesheet had already been filed and cognizance had been taken by the Trial Court. He further submits that the law laid down by the Hon'ble Supreme Court in Neeta Singh & Ors. Versus The State of Uttar Pradesh & Ors.1 is squarely applicable to the present case, and that the Petitioners may prefer a proceeding for seeking discharge.

In view of the above, the learned Advocate for the Petitioners seeks leave to withdraw this Petition, on instructions. 4.

If the Petitioners initiate proceedings for discharge, all contentions are kept open and the withdrawal of this Petition would not be an impediment.

Consequently, the Interim Application would not survive and stands disposed off.
