Heard Mr. Siddiqui, learned Advocate for Applicant and Ms. Newton, learned APP for State.

Present Interim Application is filed for seeking modification of bail condition No. 15(E) of the order passed on 05.09.2024. Mr. Siddiqui would submit that the said order requires indulgence and interference of the Court so that it can be complied with in its letter and spirit. He would submit that the passport of the Applicant is presently in custody of Saratkar Police Station in Mangalore in another crime and Applicant after his release from prison on bail will have to procure the said passport and submit the same to the Investigating Officer (IO) for compliance of the above condition. He would submit

IA-395-2025.docx that in that view of the matter, this Court can put the Applicant to appropriate terms directing that Applicant shall procure and obtain his passport which is impounded in another crime in Mangalore and once he gets the said passport, he shall deposit the same with the trial Court.

I have heard both the learned Advocates and perused the records of the case. Condition No. 15(E) simplicitor states that Applicant shall surrender his passport, if any, with the Trial Court. Said condition stands modified by the Court. It shall now read as Applicant shall on his release from bail obtain his passport from Saratkal Police Station in Mangalore and after the said passport is handed over to him, he shall deposit the same with the trial Court within a period of one week.

This order shall be read along with order dated 05.09.2024. 5.
