The aforesaid Application has been filed for seeking restoration of the Criminal Application No. 199 of 2016 seeking leave to file Appeal which was dismissed for non-prosecution. There is some delay in filing the present Application.

None had appeared on behalf of the Original Accused on 25.09.2025 when this Court had dismissed the Criminal Application. 3.

Learned Counsel for the Applicant has tendered an Affidavit of service dated 20.02.2026 which proves that Respondent No. 2 has been duly served by registered post A. D.

I have heard learned Counsel for the respective parties. I have gone through the contents of the Interim Application. 5.

I am satisfied that a case is made out to allow the Interim Application.

The Interim Application stands allowed in terms of prayer clauses (a) & (b).
