The applicant is accused in Crime No.80 of 2024 registered at Yavat Police Station, Pune for the offences punishable under Sections 307, 143, 147, 148 and 149 of the Indian Penal Code and Sections 4 and 25 of the Arms Act.

This Court by order dated 8.7.2024 in Criminal Bail Application No. 2342 of 2024 while releasing the applicant on bail has inter alia imposed the following conditions: "(b) The Applicant shall not enter the Pune district after being released on bail, except for reporting to the Investigating Officer, if called, and for attending the trial ....

(d) The Applicant shall report to the Shrigonda Police Station, District - Ahmednagar once every week, i.e. on every Sunday between 11.00 a.m. and 1.00 p.m. till the conclusion of the trial. The Police Inspector of Shrigonda Police Station, 1/3
District Ahmednagar to communicate details thereof to the Investigating Officer."

By this application, the applicant prays that the above conditions be relaxed/modified.

Learned counsel for the applicant submits that the applicant has agricultural land at his native village in Pune district and there is nobody else in his family to cultivate the said land. It is thus submitted that the condition that the applicant shall not enter the Pune district be relaxed. It is submitted that the applicant is willing to attend the Yavat Police Station as directed by this Court till the conclusion of trial and thus the condition to attend Shrigonda Police Station be modified.

On the other hand, learned APP submits that considering the nature of offence, the above conditions were imposed. It is submitted that the said conditions therefore, may not be relaxed/modified.

The applicant in support of the fact that he has agricultural land at his native village in Pune district has filed on record 7/12 extract.

Considering the over all facts and circumstances of the case, the condition that the applicant shall not enter the Pune district is hereby relaxed. The applicant shall attend the Yavat Police Station once in a week, i.e., on every Sunday between 11.00 am to 1.00 2/3
p.m. till conclusion of the trial. Consequently, the condition that the applicant shall attend the Shrigonda Police Station is also hereby relaxed.
