By this application, the applicant seeks relaxation of conditions No.(b) and (d), imposed by the Coordinate Bench of this Court (Coram: Madhav J. Jamdar, J.) by order dated 24 July 2024 at the time of granting bail. The relevant operative part of the order reads thus:-

O R D E R

(b) The Applicant shall not enter the Nashik district

after being released on bail, except for reporting to the Investigating Officer, if called, and for attending the trial.

(d) The Applicant shall report to the Kolshewadi Police Station, Kalyan, District - Thane once every week i.e. on every Sunday between 11.00 a.m. and 1.00 p.m. till the conclusion of the trial. The Police Inspector of Kolshewadi Police Station, Kalyan, District - Thane to communicate details thereof to the Investigating Officer.

Ms Savvy Kolhekar, learned Counsel appearing on behalf of the applicant contends that the applicant is a permanent resident of Nashik, where he resides with his family. However, in view of the condition restraining the applicant from entering the Nashik District, he is facing grave difficulty in arranging for the sustainance and livelihood of himself and his family while being compelled to remain outside the said district. 3.

The learned Counsel further points out that the charge sheet in the present case has already been filed before the trial Court. It is emphasised that no complaints have been registered against the applicant subsequent to the filing of the charge sheet, and that the applicant has no prior criminal

antecedents. It is also brought to the Court's attention that, although the charge sheet has been filed, the framing of the charge has not yet taken place.

The learned APP representing the respondent / State, on instructions, confirms that no complaints have been filed against the applicant after filing of the charge sheet. He submits that if the Court is inclined to relax the condition, suitable conditions may be imposed.

Considering the facts and circumstances of the case, along with the fact that no grievances have been received against the applicant subsequent to the filing of the charge sheet, this Court is inclined to allow the present application on the following terms.

Conditions No.(b) and (d), as imposed by the Coordinate Bench of this Court (Coram : Madhav J. Jamdar, J.) by order dated 24 July 2024, are hereby substituted with the following condition:

" The applicant shall report to the Kolshewadi Police Station, Kalyan, District - Thane, once in every month, specifically on the first Sunday between 11.00 a.m. and 1.00 p.m., till the conclusion of the trial."
