During the course of hearing and more particularly while going through the impugned Judgment, this Court finds that out of seven witnesses only one witness was cross examined. Though certain observations are made by the learned Sessions Judge, this Court finds it appropriate to go through the Record and Proceeding of the Sessions Case No. 1381 of 2022 before deciding the present Application. In view of this, Registry is directed to call Record and Proceedings of Sessions Case No. 1381 of 2022. It be ensure that record be placed before this Court on the next date of hearing.
