Heard learned counsel for the Applicant and learned APP for the State.

Learned counsel for the Applicant submits that this Court has released the Applicant on bail (Coram: Madhav J. Jamdar, J) on 28th March, 20224. While passing the order this Court has imposed Shantanu S. Dhudum 1/3

the condition No.(b) on the Applicant, "the Applicant shall not enter Pune District after being released on bail, except for reporting to the Investigating Officer, if called, and for attending the trial". 3.

Learned counsel further submitted that this Court has imposed the condition No.(d) on the Applicant, "The Applicant shall report to the Khopoli Police Station, District - Raigad once every week, on every Sunday between 11:00 a.m. and 1:00 p.m. till the conclusion of the trial. The Police Inspector of Khopoli Police Station, District - Raigad to communicate details thereof to the Investigating Officer.

Learned counsel further submitted that now investigation is completed and charge sheet is filed against the Applicant and Applicant is attending the Court's date regularly. The Applicant's family stay in Pune and he has to take care of his wife. Hence, requested to relax both conditions.

Learned APP strongly objected to allow the application on the ground that the offence under Section 363, 376(2)(n), 376D, 328, 324 read with Section 34 of the Indian Penal Code, 1860 (for short "IPC") and Sections 4, 5(1), 6 and 8 of the Protection of Children from Sexual Offences Act, 2012 (for short "POCSO Act") Shantanu S. registered against the Applicant. If conditions are relaxed, the Applicant may threaten the prosecution witness and victim. Hence, requested to reject the application.

I have heard both learned counsel.

Considering the submission of both learned counsel as well as charge sheet is filed against the Applicant and the Applicant is attending the Court's date regularly, I pass following order:-

ORDER

i. The Condition No.(b) imposed on the Applicant by this Court (Coram: Madhav J. Jamdar, J.) by order dated 28th March, 2024, is hereby relaxed. ii. Condition No.(d) is modified read as under:- "(a) The Applicant shall attend the Hinjawadi Police Station as and when required."
