This Court by order dated 09.09.2024 in Bail Application No. 1836 of 2024 while releasing the applicant on bail has inter alia imposed the following conditions:

"(b) The Applicant shall not enter the Pune District after being released on bail, except for reporting to the Investigating Officer, if called and for attending the trial. ...

....

(d) The Applicant shall report to the Wadivarhe Police Station, District - Nashik twice in a week, i.e., on every Wednesday and Sunday between 11.00 a.m. and 1.00 p.m. until the conclusion of the trial. The Police Inspector of Wadivarhe Police Station, District-Nashik to communicate details thereof to the Investigating Officer." 3.

By this application, the applicant seeks relaxation of the aforesaid conditions.

The learned counsel for the applicant submits that to earn livelihood, the wife of the applicant is running garment shop at Pune. It is submitted that the applicant may be permitted to stay at Khopoli so that his family members can meet him. The learned counsel for the applicant has placed the documents on record to that effect.

On the other hand, learned APP for the respondent/State submits that considering the nature of offence and the criminal antecedents of the applicant, the above conditions were imposed. It is submitted that the conditions therefore, may not be relaxed. 6.

It appears that the applicant was in jail for about 6 years. The applicant has not breached the above conditions. Considering the overall facts and circumstances, I am inclined to relax the condition No. (d). Accordingly, the condition that the Applicant shall report to the Wadivarhe Police Station, District - Nashik twice in a week, i.e., on every Wednesday and Sunday between 11.00 a.m. and 1.00 p.m. until the conclusion of the trial. The Police Inspector of Wadivarhe Police Station, District-Nashik to communicate details thereof to the Investigating Officer, is hereby relaxed.

The applicant shall stay at Khopoli, District-Raigad and shall attend the Khopoli Police Station once in a month, i.e., on 1st Saturday between 11.00 am to 2.00 pm till conclusion of trial. 2/3

The applicant shall submit his residential address and the contact number, if any, to the Khopoli Police Station so also Lashkar Police Station, Pune.
